Terms of Use Agreement for FapTok Platform

By accessing, browsing, or using the website located at fap-tok.net ("FapTok," "the Platform," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and FapTok Network.

If you do not agree to all the terms and conditions contained herein, you must immediately discontinue all use of the Platform. Your continued use of the Platform following the posting of any changes to these Terms constitutes your acceptance of those changes.

The Platform, including its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof), are owned by FapTok Network, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The "FapTok" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FapTok Network or its affiliates or licensors. You must not use such marks without the prior written permission of FapTok Network.

You retain ownership of any content you create and submit to the Platform ("User Content"). However, by submitting User Content, you grant FapTok a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Platform and FapTok's business.

To the fullest extent permitted by applicable law, in no event shall FapTok Network, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform.
• Any conduct or content of any third party on the Platform.
• Any content obtained from the Platform.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total cumulative liability to you for all claims arising from or related to the Platform shall not exceed the amount you have paid to FapTok in the twelve (12) months preceding the event giving rise to the liability, or one hundred US dollars (USD $100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

YOUR USE OF THE PLATFORM AND ITS CONTENT IS AT YOUR SOLE RISK. THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FAPTOK NETWORK EXPLICITLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

FapTok Network makes no warranty or representation that:

• The Platform will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
• The quality of any content, products, services, information, or other material obtained through the Platform will meet your expectations.
• Any errors in the Platform will be corrected.

No advice or information, whether oral or written, obtained from FapTok or through the Platform will create any warranty not expressly made herein.

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Platform will cease immediately. If you wish to terminate your account, you may simply discontinue using the Platform or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Platform shall be instituted exclusively in the courts located in London, United Kingdom. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Platform.
